Real Estate Closings

Whether you are buying/selling a home or getting a mortgage on property you already own, you will need a closing attorney. Be sure to tell your agent and/or lender that you want F. Title Examinations

Are you an investor thinking of buying a foreclosure? Or maybe you are looking at a property and want to know if the title is clear before making an offer. We can help in those situations. We can examine the title on a property and let you know if it is clear to purchase, or if there are issues that would need to be resolved before clear title could pass to you. You certainly would not want to buy a property at foreclosure and find out that you have purchased a second mortgage, or that the borrower had a federal tax lien that survived the foreclosure. Those are the type things we can find out when we examine the title to the property for you.

Title Insurance

We are licensed title insurance agents with Stewart Title Guaranty and Chicago Title Insurance Company. We perform a title exam in connection with all of our closings, but there are some items that could affect your title that can’t be discovered in a title exam. Certain boundary line issues, documents on record that were forgeries, lack of notice given in a probate matter and documents mis-indexed by the clerk of court are just a few of the things that could cause a title issue that we would not be able to discover in our exam. With every purchase closing we perform, we issue the buyer and owner’s title insurance policy, and the lender a separate lender’s title insurance policy (if a loan is involved). In this way, you are protected for the life of your ownership of the property in case an issue should arise in the future.

Deed Preparation

Do you need to gift a piece of property to a relative or add a child/spouse to your deed? Drafting of deed in the State of Georgia is considered a practice of law and should only be drawn by licensed attorneys. Many times “do it yourself” deeds sold on the internet and in retail stores do not meet the recording requirements of the Sate of Georgia, and cause more problems down the line when those invalid deeds are used and they have to be corrected at some point in the future. We will be glad to prepare a deed for you that meets all of the requirements of the Georgia recording statute.

Contracts & Leases

If you are looking to buy or sell a piece of property an there is no agent involved, we can gladly prepare a custom contract for all parties to execute. If you have a property you are looking to rent, and need a lease agreement, we can draft that for you as well.

Zoning

Do you have a piece of property that needs to be re-zoned? Or maybe a variance to cure an existing condition? We can handle those matters for you. Every local government has its own set of rules for making application, filing the necessary associated paperwork and going before its particular board or commission in order to get approval.
